1. Agreement to Terms

By accessing or using the CalmKin store (calmkin.store), you agree to these Terms of Service. If you do not agree, please do not use our store.

2. Fulfillment by Supply Partners

Orders are fulfilled by our supply partners and shipped directly to you. Shipping estimates provided at checkout and in our Shipping Policy are estimates, not guarantees. Product images are for illustration; actual products may vary slightly in color, size, and appearance due to manufacturing variations.

3. Pricing and Payment

All prices are in US dollars. Payment is charged at checkout. If we discover a pricing error (including incorrect compare-at prices or discounts), we reserve the right to correct the error, cancel the affected order, and issue a full refund. You will be notified by email if your order is cancelled due to a pricing error.

4. Shipping and Returns

Shipping times, rates, and policies are described in our Shipping Policy. Returns and exchanges are governed by our Returns & Exchanges page. By placing an order, you agree to those policies.

5. Comfort Products; No Medical Claims

CalmKin products are comfort plush products, not medical devices. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. We make no medical claims about our products. Consult a qualified healthcare professional for medical advice.

6. Warranty Disclaimer

Products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law, CalmKin's total liability for any claim arising from your purchase or use of our products shall not exceed the amount you paid for the order giving rise to the claim. In no event shall CalmKin be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits or data. This limitation does not apply to liability arising from CalmKin's gross negligence or willful misconduct.

8. Acceptable Use; Fraud

You agree not to use our store for any fraudulent purpose, including chargeback abuse, payment fraud, or misrepresentation. We reserve the right to cancel orders, suspend accounts, and report fraudulent activity to the appropriate authorities.

9. Intellectual Property

All content on the CalmKin store, including text, images, logos, product designs, and the "CalmKin" name, is the property of CalmKin and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

10. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the store shall be brought exclusively in the state or federal courts located in North Carolina. 11. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12. Changes to Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the store after changes are posted constitutes your acceptance of the updated Terms.
